O-1 Visa Approval for Award-Winning Filmmaker
From an Impressive Film Career to an O-1 Visa Approval Opportunity
Born and raised in Colombia, Cristian built an impressive career as a filmmaker with a passion for storytelling. He co-founded an audiovisual company in Medellín, where he demonstrated his talent in photography, videography, and editing.
His work eventually reached audiences far beyond Colombia. Cristian contributed to international commercials, earned multiple awards and nominations for his short films and documentaries, and had his short film Lunesta featured at the prestigious Cannes Film Festival.
While Cristian was in the United States, he collaborated with several distinguished clients who were eager to work with him. He needed a work visa but wasn’t sure which visa was appropriate or whether his accomplishments would qualify him.
I met Cristian on the set of a project he was working on, and he later hired me to assess his professional portfolio and immigration options.
Determining Eligibility for an O-1 Visa
Based on the information Cristian initially provided, I wasn’t certain whether he had enough evidence to qualify for an O-1 Visa. However, I had a strong sense that a deeper review of his career and accomplishments could reveal a much stronger case.
I gave Cristian a detailed set of questions and asked him to answer each one thoroughly. Once I reviewed his responses, I knew we had the evidence needed to build a strong O-1 Visa petition based on his achievements in filmmaking.
Preparing Cristian’s case presented several challenges. We needed to obtain supporting letters and evidence from multiple countries, clearly explain his different roles and experiences within the filmmaking industry, and address his work with multiple employers, which required two separate agency consultation letters.
After we submitted the O-1 petition, we encountered another significant hurdle: a lengthy Request for Evidence (RFE) from U.S. Citizenship and Immigration Services (USCIS).
Responding to an O-1 Visa Request for Evidence
USCIS raised concerns about Cristian’s English proficiency and student status and did not appear to consider significant portions of the evidence we had submitted. An entire category of evidence was not addressed.
I remained confident that Cristian qualified for an O-1 Visa. Our job was to respond thoroughly to USCIS and clearly demonstrate how the evidence supported his eligibility.
Receiving an RFE can be discouraging, and applicants sometimes begin to question the strength of their case. Cristian remained confident throughout the process. He told me, “I am with you. I have complete faith in you.”
We prepared a comprehensive response addressing every issue raised in the RFE. We explained previously submitted evidence, provided additional supporting documentation, and made sure that no question went unanswered.
Our response demonstrated that Cristian satisfied five O-1 Visa criteria, exceeding the minimum of three applicable evidentiary criteria, while also addressing USCIS’s concerns regarding his previous F-1 student status.
O-1 Visa Approved Without Premium Processing
Within just a few weeks of submitting our RFE response, and without premium processing, Cristian’s O-1 Visa petition was approved.
Cristian’s story demonstrates how important it can be to look beyond someone’s job title when evaluating eligibility for an O-1 Visa. His accomplishments spanned different roles, projects, countries, awards, and areas of filmmaking. The challenge was bringing that evidence together to clearly demonstrate the significance of his work and achievements.
I believed in Cristian’s talent and the strength of his case, and I wasn’t willing to settle for anything less than presenting the strongest petition possible. I’m thrilled that we achieved the approval he deserved and excited for Cristian to continue pursuing his filmmaking career in the United States.
