O-1B Visa for Chefs

Are you a renowned culinary artist interested in working in the United States? What is an O-1 Visa?

The O-1 visa category is designed for individuals who possess an extraordinary ability in their respective fields. For example, those with extraordinary ability in the sciences or athletics fall under the category of potential O-1A visa beneficiaries. In your case, culinary artists fall into the category of potential O-1B visa beneficiaries: individuals with extraordinary ability in the cooking, preparation and service of food. O-1 visa eligibility hinges on the ability to demonstrate a high level of achievement in your field of choice. This could be proven through your degree of skill and/or recognition for your capabilities. To qualify, chefs (such as yourself) must prove they are of  ‘distinction’, renowned, leading, or well-known in the culinary world​​​​.

Demonstration of Extraordinary Ability

Chefs applying for the O-1 visa must be culinary artists of exceptional talent and fame. In order to demonstrate such abilities and acclaim, you must submit supporting documentation such as:

  • Significant national or international awards and prizes in the culinary field;
  • Starring roles in shows, advertisements, or endorsements; 
  • National or international recognition through publications in newspapers, journals, magazines, etc.;
  • Important roles in established organizations that highlight your talent in newspapers or other publications;
  • Critically acclaimed success that is shown through high rating in culinary publications other distinct achievements in the culinary field; and 
  • Significant recognition from experts in the culinary field through their testimonials of your talent.

If you are able to provide such documentation, you are more than likely eligible to apply for an O-1 visa.

Application Process for the O-1B Visa as a Chef

In addition to the supporting documents required to demonstrate your extraordinary ability, in order to petition for an O-1 visa, you must also obtain the following: 

  • A US petitioner who intends to employ and sponsor you;
  • A skilled culinary professional with significant experience who will be able to provide evidence of at least three out of six of the evidentiary criteria stated above;
  • A support letter from your US petitioner in support of your petition; and 
  • A consultation letter from the American Culinary Federation (ACF) highlighting your culinary achievements.

Once you have secured a US petitioner and the aforementioned supporting documents, you will be ready to begin completing the requisite forms for the O-1B visa.
